ASSUMPTION OF RISK
I understand that snowshoeing, fat biking, cross-country skiing, and related activities are physically demanding and involve inherent risks, including but not limited to falls, collisions, loss of control, changing weather, uneven or icy terrain, equipment malfunction, serious injury, and death.
I freely accept and fully assume all risks associated with the rental and use of the Equipment.
RELEASE OF LIABILITY
In consideration of being permitted to rent and use the Equipment, I hereby release and discharge Centennial Outdoor Centre Inc., Camp Centennial, the City of Moncton, and their respective directors, officers, employees, volunteers, contractors, and partners (the “Releasees”) from any and all liability for injury, loss, damage, or death arising out of or related to my use of the Equipment, including claims arising from negligence.
INDEMNITY
I agree to indemnify and hold harmless the Releasees from any claims, damages, costs, or legal fees arising from my use or misuse of the Equipment, or from any claim brought on behalf of a minor participant.
EQUIPMENT USE & RESPONSIBILITY
Equipment must be used only within Centennial Park unless otherwise authorized.
Equipment must be returned within 1 hour of rental start time.
I confirm the Equipment is in acceptable condition prior to use (or have reported concerns).
I am responsible for the Equipment from pickup until accepted upon return.
I agree to pay the full cost of repair or replacement for lost, stolen, or damaged Equipment beyond normal wear and tear.
I confirm I am physically capable of safely using the Equipment.
MINORS
If signing on behalf of a participant under 18, I confirm I am the parent/legal guardian, consent to participation, and agree to be legally bound by this Agreement on behalf of the minor.
This Agreement is governed by the laws of the Province of New Brunswick and is binding upon me, my heirs, and assigns.
